Terms of Service and Agreement

1. General

This document is an agreement between Rando.ge (the “Provider”) and an individual or legal entity (the “Client”). By ordering a service or paying a subscription fee, the Client fully accepts these terms.

2. Subject of the service

The Provider undertakes to build, host and technically maintain a website for the Client, under the terms of the chosen plan (rental or purchase). The service includes web design, software code, hosting and technical support.

3. Rental and payment terms

3.1. Payment: on a subscription plan (SaaS), payment is made monthly, in advance.

3.2. Late payment: if a payment is more than 5 (five) days overdue, the Provider may temporarily suspend the website.

3.3. Restoration: the service (the website) is restored as soon as the debt is paid in full.

4. Intellectual property

4.1. Client property: all visual and text materials (logo, photos, texts) the Client provides to the Provider remain the Client’s property.

4.2. Provider property: the website’s software code, design structure, administration panel and technical architecture are the intellectual property of Rando.ge.

4.3. Restriction: during the rental period, the Client may not copy, reproduce or move the website’s code to another server without the Provider’s written consent.

5. Right to buy out

The Client may request a full buyout of the website at any time. Once the buyout price (set individually) is paid, full ownership of the site’s code passes to the Client and the monthly subscription fee ends.

6. Limitation of liability

6.1. The Provider is not liable for outages of third-party services (Google, Facebook, hosting providers).

6.2. The Provider is not liable for the sales performance of the Client’s business. Our obligation is limited to delivering a technically working product.

6.3. The Client is fully responsible for the lawfulness of the information published on their website.

7. Termination

The Client may end the cooperation at any time. After the service ends, if the site has not been bought out, the Provider may take the website offline and delete its data from the server 30 days after payments stop.
